PSI Instrumental in Successful $84,000,000 Verdicts

Carpio vs. Aubin - $28,000,000 Verdict against Caltrans 
The scenario for this case is a pedestrian was struck at night in a poorly lit crosswalk on a freeway onramp. Using our 3D Laser Scanning system, PSI illustrated the difficult visibility conditions that were exacerbated by poorly maintained and faded crosswalk lines. The crosswalk was positioned behind a vertical curve and with minimal warning signs altering oncoming drivers of the crosswalks existence. In addition, PSI created a driver’s eye video of the onramp with overlays of speed and time to impact showing the jury the conditions drivers faced at the time of the accident.

During trial, Craig Fries used driver’s eye video of the onramp with overlays to illustrate that a pedestrian wishing to cross in the crosswalk against 50 mph traffic would require nearly 900 feet of clearance to the closest vehicle to cross safely – a condition that rarely occurs due to the high level of traffic volume in the area.

Anderson vs. CalTrans - $56,000,000 Verdict

A roadway worker is struck by car while working in the shoulder of the road, suffering massive brain trauma.
The victim was working in a shallow hole and was protected from passing vehicles
by a Front Loader / Backhoe and a series of traffic cones. The construction foreman had requested a lane closure from CalTrans which was denied, although construction that was simultaneously occurring on the opposite side of the street was granted a protective lane closure. The Caltrans safety foreman required workers to remove the Front Loader / Backhoe and replaced it with a series of work lights, removing the only physical protection for the worker against oncoming traffic - while still denying the requested lane closure.

Minutes later, a driver drifted onto the shoulder and struck the worker as he was seated on the edge of the hole. PSI used the 3D Laser Scan system to recreate the scene as it was at the time of the accident and as it was prior to changes required by Caltrans. At trial, Craig Fries presented an ultra-realistic drivers eye video, animating in 3D the placement of the Front Loader / Backhoe and a second scenario showing the requested and denied lane closure. These compelling presentations illustrated the effectiveness of either method of protection that was denied this worker.
