Raymond Tensing was tried twice for the shooting death of Sam DuBose. Each trial ended with a hung jury, with each jury unable to reach an agreement that Tensing’s actions were other than self-defense. In the first trial, the prosecution used a video expert to dissect the video footage frame by frame. This expert concluded, based solely upon the video, that Tensing had not been in danger at the time he fired the fatal shot. The Defense countered that Tensing had been in danger of being struck or run over by the fleeing vehicle. In the second trial, the prosecution again used the same video expert, who again limited his analysis solely to the frames of the video. However, in the second trial the Defense also hired a consultant, with no previous experience in video analysis, who, although he provided no rational or scientific basis for his conclusion, opined that Tensing had been in danger and that the vehicle had moved 9 feet at the time of the shot.

PSI recently produced an animation that was instrumental in a $9,750,000 settlement for the wrongful death of an infant. One of the largest settlements in CA history for an infant death.

PSI was instrumental in two recently successful verdicts equaling $84,000,000. Carpio vs. Aubin for $28,000,000 and Anderson vs. CalTrans for $56,000,000. Both of these cases featured 3D Laser Scanning to recreate the scene and driver's eye video to recreate perspective.

Why/ what are the challenges in presenting this type of evidence in a valid manner? If performing the recreation with sufficient fidelity to the real-world event was as easy as pressing “record” on the camera we have available, this discussion would have been closed permanently and 24 years ago I would have been involved in something entirely different. Instead the innovations and refinements continue unabated from various areas of science and forensics analysis, from psychologists, accident reconstructionist and vision sciences to color theorists, electrical engineers and signal processing professionals.

When I started in the Forensic Analysis industry 24 years ago, my first task was sitting in a dark room watching reels of 8mm and soon after, 16mm film. The subject of these movies was the current state of the art attempts at performing nighttime accident reconstruction from a driver’s perspective. The film camera would be setup in a vehicle, presumably at the driver’s eye height, and the exemplar driver would travel towards an exemplar subject, say a pedestrian who had been struck in a crosswalk.

In this day and age, it seems that just about every event is captured by video either via surveillance cameras or cell phones. Once a video’s frame rate is established it is not difficult to create a timeline of events. However, in this case we don’t have the ability to create or piece together a timeline from video as we have an audio file from a 911 call that lasted throughout the events presented at trial. Armed only with this audio and witness statements, PSI was tasked to create an animation of the event.

A 20-year-old man was ordered to stand trial for murder in connection with the December 8, 2014 shooting death of his mother at their home near Lake Berryessa in Napa County, California. Joseph Brooks Conkright, known as Brooks, told authorities that he accidentally shot Danae Dee Conkright, 54, while cleaning his rifle in the family’s living room. If found guilty Brooks could be sent to prison for life.
